Response to case study scenario 1

In this case study there are two main issues the legal issues and the moral issues. In The legal case it is your duty to report it; it says in the sales of goods act 1979 it states that goods must conform to the contract which means that the goods must have no faults. If the customer does experience this fault they could take legal action against this company, this could damage the company reputation and it cold also cost the company loads of money, and if somebody is severely injured or killed then somebody at the company could be prosecuted and maybe have a prison sentence.
As fair as the moral issues go, do you want a possible death or sever injury on your conscience. But there is also the loyalty issue, most people respect there managers which means you will probable find it really hard to go behind his back. Managers also expect there workers to respect them, he may find that you have betrayed him and could treat you really badly at work by such means as verbal bulling or physical bulling. The company may also take legal action against the manager who ignored the faulty product to try and recover some of the cost that they lost due to the law suit against them. He will also probably get the sack as well, if you don’t report the problem you may also face getting the sack because you failed to make the company aware of the faults and you to could also face prosecution as you have broken the law.

My decision would be to inform the boss of the company, the steps I would take are to inform the most senior manager about the problem with the fault batch and ask him to recall that entire batch. If he dos nothing then you should take it to the managing director (MD) and inform him of what has happen and the legal impaction of the company.
